For the sake of simplicity, “Artist” pertains to It Knows (me), “Client” pertains to the Buyer (you), and “Work” pertains to the service offered (the commission/artwork)

GENERAL NOTES1.1 Upon the confirmation of the request, the request would start getting worked on, on average would be in two days to two weeks' time.1.2 All communication will be conducted through Vgen.1.3 Unless requested or specified, the client expects to receive primarily two (2) update works throughout the transaction: (1) Sketch, and (2) the Final Delivery.1.4 A sketch will be sent to the client when there is one, and this should be the timeframe wherein the client can still ask for changes, whether that be simple or drastic.1.5 Client gets up to one (1) free DRASTIC REVISION, so it is recommended to be as detailed with feedback if there is one. Any further drastic changes may incur additional charges, depending on what was requested.1.6 Failure to get a response from the client in two (2) days time upon sending the sketch, the client would be notified again via Vgen Direct Message. If there is no reported response within 24 hours upon being re-notified, the client acknowledges that the sketch would be deemed as 'ACCEPTED' and will proceed with getting finished up.1.7 If the client manages to respond and the artist has not yet made significant progress since, the delayed response would be acknowledged and feedback will be applied if there is one.1.8 Once Final Delivery is ready, the client is asked for one last feedback in case of small changes that might have been overlooked. At this point, drastic revisions are no longer applicable.Below are examples of what counts as DRASTIC REVISIONS:
✧ Removal of aspects in the design that is integrated into the subject (Example: Removing a character's hat attached to their head.);
✧ Changing the subject's pose and expression;
✧ Changing the work's composition;
✧ Changing the subject's design;
✧ (When availing the Background Add-on) Changing the background;
✧ Adding a new subject (Additional Character) mid-way (Additional character fees will apply).Examples of ACCEPTABLE REVISIONS that can still be worked around on in the Final Delivery (these are also free revisions even in the sketch phase and don't count as using up the revision pass):
✧ Color Correction;
✧ Adding small Details / Features that were overlooked;
✧ Removing elements that don't overtake the subject;
✧ Hard to overlook anatomy mishaps (only free during the sketch phase);1.9 Failure to get a response from the client in two (2) days time upon sending the Final Product, the client would be notified again via VGen Direct Message. If there is no reported response within 24 hours upon being re-notified, the client acknowledges that the work would be deemed as 'ACCEPTED' and Final Delivery will be made regardless of confirmation.1.10 The artist will not use A.I. generated images as reference nor as feedback. They can - and will - terminate the commission if that hapens.

ABOUT REFUND2.1 If the artist has not started or made any progress (including sending a sketch) upon the client requesting a refund, the client is entitled to 95% of the refundable amount, with a 5% cancellation fee. (Example: In issuing a refund for a $100 commission, client will receive $95 while the artist keeps $5).2.2 If the artist has already sent the sketch and/or made significant progress (line art / flat coloring done), upon the client requesting a refund, the client is entitled to 20% of the refundable amount, with an 80% cancellation fee. (Example: In issuing a refund for a $100 commission, client will receive $20 while the artist keeps $80).2.3 If the artist has had the Final Delivery approved (either through the client’s direct confirmation or by virtue of General Notes No. 1.9 ) and submitted through VGen’s channels, the client acknowledges that they are no longer entitled to any form of refund.2.4 If the artist has not updated the client on the progress of the work and has failed to deliver the finished product on the indicated Guaranteed Delivery Date for the commission, the client has the right of choice to either give the artist grace or issue a refund if they please, with the full amount refunded to the client as per VGen's rules. It’s worth noting that upon issuing this refund, the client can no longer receive the artwork and the commission will be void.2.5 If the artist within reason suddenly decides to cancel the commission due to certain circumstances, the client will be refunded the full amount disregarding commission progress level. The commission will be considered void and no work will further be accomplished.2.6 If time has passed and the artist has either improved or changed into a new style, the client is not entitled to a free redux or a refund for the commission; should the client wish to have a new rendition of their previous commission, they must fill out a new commission request.

ARTIST RIGHTS3.1 The Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising the Work and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch, Tiktok) and more, unless stated otherwise by the clients’ wishes. Fees may apply.3.2 The Artist does not reserve the right to profit further off of the commissioned artwork, including commissioned fan arts.3.3 The Artist reserves the right to decline a commission request regardless of reason.

CLIENT RIGHTS4.1 Clients receive exclusive, non-transferable usage rights to the Work for personal use.4.2 Personal use means: display on social media accounts for promotional purposes with no direct monetization, such as profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels.4.3 Client must not claim Work as their own, crediting me using my social media username is highly encouraged.4.4 Client must not edit or modify Work in any way, this includes “finishing” the sketch to your own volition, commissioning somebody else to finish it, or feeding the artwork to Generative AI.4.5 Client must not remove my signature form the Work.

COMMERCIAL RIGHTS5.1 Commercial rights means usage of Work on streams, videos and other content, or any monetized instances, or selling or reselling Work to another party, as a part of any product, or on another platform.5.2 Commercial rights depend on the commercial license availed and the additional cost may vary.5.3 Monetized/Commercial content means: Using the product in digital content that produce revenue (Youtube Video Thumbnails, Twitch Streams, etc.). In some commissions options, this now comes with the client's general rights rather than a separate license to avail.5.4 Paying for the Commercial License for Merchandise allows the use for production of physical goods containing the work, with the purpose of selling, distributing, and profiting off of the work: including but not limited to: art trinkets, pins, keychains, physical book covers, clothes, digital products, video games and more.5.5 In the case of design work for the definition of the Client's brand identity such as character design, and more, intellectual property rights of the designs are exclusively granted to the Client for use, production and modification purposes, both personal and commercial (content) and commercial (merchandise).5.6 Usage of work for generative AI (artificial intelligence) tools, platforms or programs, ML (machine learning) tools, platforms or programs, NFT (non-fungible token)/crypto blockchains or any other for-profit schemes and platforms, ESPECIALLY those notorious for continuously disrespecting the ethics and wishes of the art community are strictly PROHIBITED and the artist does NOT consent to this.

Para simplificar, "Artista" refere-se a It Knows (eu), "Cliente" refere-se ao Comprador (você) e "Obra" refere-se ao serviço oferecido (a encomenda/arte).

NOTAS GERAIS1.1 Após a confirmação da solicitação, o trabalho será iniciado, em média, dentro de dois dias a duas semanas.1.2 Toda a comunicação será feita através do Email.1.3 Salvo solicitação ou especificação em contrário, o cliente irá receber principalmente duas (2) atualizações durante a transação: (1) o esboço e (2) a entrega final.1.4 Um esboço será enviado ao cliente assim que estiver pronto, e este será o período em que o cliente ainda poderá solicitar alterações, sejam elas simples ou drásticas.1.5 O cliente tem direito a até uma (1) REVISÃO DRÁSTICA gratuita, portanto, recomenda-se fornecer o feedback mais detalhado possível. Quaisquer outras alterações drásticas poderão acarretar custos adicionais, dependendo do que foi solicitado.1.6 Caso não haja resposta do cliente em até dois (2) dias após o envio do esboço, o cliente será notificado novamente por Email. Caso não haja resposta em até 24 horas após uma nova notificação, o cliente reconhece que o esboço será considerado 'ACEITO' e prosseguirá com a sua finalização.1.7 Se o cliente responder e o artista ainda não tiver feito progresso significativo desde então, o atraso na resposta será reconhecido e o feedback será aplicado, se houver.1.8 Assim que a Entrega Final estiver pronta, o cliente será solicitado a fornecer um último feedback para o caso de pequenas alterações que possam ter passado despercebidas. Neste ponto, revisões drásticas não são mais aplicáveis.Abaixo estão exemplos do que se considera REVISÕES DRASTICAS:
✧ Remoção de aspectos do design que estejam integrados ao personagem (Exemplo: Remover o chapéu preso à cabeça de um personagem);
✧ Alteração da pose e expressão do pernagem;
✧ Alteração da composição da obra;
✧ Alteração do design do personagem;
✧ (Ao utilizar o complemento de fundo) Alteração do fundo;
✧ Adição de um novo personagem (personagem adicional) no meio do processo (taxas adicionais serão aplicadas para personagens adicionais).Exemplos de REVISÕES ACEITÁVEIS que ainda podem ser trabalhadas na Entrega Final (estas revisões também são gratuitas, mesmo na fase de esboço, e não contam como uso da rodada de revisões):
✧ Correção de cor;
✧ Adição de pequenos detalhes/características que foram esquecidos;
✧ Remoção de elementos que não se sobrepõem ao personagem principal;
✧ Erros de anatomia difíceis de ignorar (gratuitos apenas durante a fase de esboço).1.9 Caso nao haja resposta do cliente em até dois (2) dias antes da entrega do Produto Final, o cliente será notificado novamente via Email. Se nao houver resposta em 24 horas após a nova notificação o cliente reconhece que o Produto Final não será entregue até que o pagamento integral seja realizado.1.10 O artista não utilizará imagens geradas por IA como referência nem como feedback. O artista pode – e ira – rescindir o contrato da Obra se isso acontecer.

SOBRE PAGAMENTO E REEMBOLSO
2.1 O pagamento pode ser feito integralmente antes da encomenda ser iniciada ou 50% antes da encomenda ser iniciada e 50% após a encomenda ser finalizada. O desenho só será mandado com qualidade alta após o pagamento integral da encomenda.2.1 Se o artista não tiver iniciado ou feito qualquer progresso (incluindo o envio de um esboço) no momento em que o cliente solicitar um reembolso, o cliente terá direito a 95% do valor reembolsável, acrescido de uma taxa de cancelamento de 5%. (Exemplo: Ao emitir um reembolso para uma encomenda de R$100, o cliente receberá R$95, enquanto o artista ficará com R$5).2.2 Se o artista já tiver enviado o esboço e/ou feito progresso significativo (arte final/coloração base concluída), no momento em que o cliente solicitar um reembolso, o cliente terá direito a 20% do valor reembolsável, acrescido de uma taxa de cancelamento de 80%. (Exemplo: Ao emitir um reembolso para uma encomenda de R$100, o cliente receberá R$20, enquanto o artista ficará com R$80).2.3 Se a Entrega Final tiver sido aprovada pelo artista (seja por meio da confirmação direta do cliente ou em virtude das Notas Gerais nº 1.9) e enviada por Email, o cliente reconhece que não terá mais direito a qualquer tipo de reembolso.2.4 Se o artista não tiver atualizado o cliente sobre o andamento do trabalho e não tiver entregado o produto final na Data de Entrega Garantida indicada para a encomenda, o cliente poderá optar por conceder ao artista um prazo adicional ou emitir um reembolso, se assim o desejar, o valor total será reembolsado ao cliente. É importante observar que, após a emissão deste reembolso, o cliente não poderá mais receber a Obra e a encomenda será anulada.2.5 Se o artista, dentro de um prazo razoável, decidir cancelar a encomenda devido a certas circunstâncias, o cliente receberá o reembolso do valor total, independentemente do nível de progresso da encomenda. A encomenda será considerada nula e nenhum trabalho adicional será realizado.2.6 Se tiver decorrido tempo e o artista tiver melhorado ou mudado para um novo estilo, o cliente não terá direito a uma nova versão gratuita ou a um reembolso da encomenda; caso o cliente deseje uma nova versão da sua encomenda anterior, deverá solicitar uma nova encomenda.

DIREITOS DO ARTISTA3.1 O Artista detém os direitos autorais, de propriedade, de redistribuição e de propriedade intelectual, incluindo, entre outros, a exibição e a divulgação da Obra e do trabalho em andamento em sites, mídias sociais, portfólios, canais de transmissão pública (como Twitch, TikTok) e outros, a menos que o cliente estipule o contrário. Taxas podem ser aplicadas.3.2 O Artista não se reserva o direito de obter lucro adicional com a obra encomendada, incluindo encomendas de fanarts.3.3 O Artista se reserva o direito de recusar um pedido de encomenda, independentemente do motivo.

DIREITOS DO CLIENTE4.1 Os clientes recebem direito de uso exclusivo e intransferível da Obra para uso pessoal.4.2 Uso pessoal significa: exibição em contas de mídias sociais para fins promocionais sem monetização direta, como fotos de perfil, banners e posts; impressão e emolduramento em espaços pessoais; exibição como parte de designs em sites e canais, excluindo o uso no conteúdo desses sites ou canais.4.3 O cliente não deve reivindicar a Obra como sua, sendo altamente recomendável me creditar usando meu nome de usuário nas mídias sociais.4.4 O cliente não deve editar ou modificar a Obra de forma alguma, incluindo "finalizar" o esboço por conta própria, encomendar a outra pessoa para finalizá-lo ou alimentar a arte com IA generativa.4.5 O cliente não deve remover minha assinatura da Obra.

DIREITOS COMERCIAIS5.1 Direitos comerciais significam o uso da Obra em transmissões, vídeos e outros conteúdos, ou quaisquer instâncias monetizadas, ou a venda ou revenda da Obra para terceiros, como parte de qualquer produto ou em outra plataforma.5.2 Os direitos comerciais dependem da licença comercial adquirida e o custo adicional pode variar.5.3 Monetizado/Conteúdo comercial significa: Usar o produto em conteúdo digital que gere receita (miniaturas de vídeos do YouTube, transmissões da Twitch, etc.). Em algumas opções de encomendas, isso vem com os direitos gerais do cliente, em vez de uma licença separada.5.4 O pagamento da Licença Comercial para Mercadorias permite o uso da obra na produção de bens físicos contendo a obra, com o objetivo de vendê-la, distribuí-la e lucrar com ela, incluindo, entre outros: objetos de arte, pins, chaveiros, capas de livros físicos, roupas, produtos digitais, videogames e muito mais.5.5 No caso de trabalhos de design para a definição da identidade da marca do Cliente, como design de personagens, e outros, os direitos de propriedade intelectual dos designs são concedidos exclusivamente ao Cliente para fins de uso, produção e modificação, tanto pessoais quanto comerciais (conteúdo) e comerciais (mercadorias).5.6 O uso da obra para ferramentas, plataformas ou programas de IA generativa (inteligência artificial), ferramentas, plataformas ou programas de ML (aprendizado de máquina), NFTs (tokens não fungíveis)/criptomoedas ou quaisquer outros esquemas e plataformas com fins lucrativos, ESPECIALMENTE aqueles notórios por desrespeitarem continuamente a ética e os desejos da comunidade artística, é proibido. É estritamente PROIBIDO e o artista NÃO consente com isso.
